Rules and Regulations for the State of Wyoming

Sales Tax Law:

Wyoming, in 2018 passed House Bill 103, the Wyoming Legal Tender Act. House Bill 103 says that “no specie or specie legal tender shall be characterized as personal property for the purposes of property taxation,” “the exchange of one type or form of legal tender for another type or form of legal tender shall not give rise to any tax liability of any kind,” and, “the purchase, sale, or exchange of any type or form of specie or specie legal tender shall not give rise to any tax liability of any kind.”

House Bill 103 defines specie as “coin having gold or silver content; or refined gold or silver bullion which is coined, stamped or imprinted with its weight and purity and valued primarily based on its metal content and not its form.”

House Bill 103 defines specie legal tender as “specie coin issued by the United States government at any time; specie coin issued by any foreign government at any time; any other specie that a federal court of competent jurisdiction, by final and unappealable order, rules to be within state authority to make or designate as legal tender. No court of the state of Wyoming shall be deemed to be a court of competent jurisdiction for purposes of this paragraph.” NPMEX is required to collect tax on some items shipping to Wyoming, however sales tax will not be charged for Gold or Silver bullion items we sell as they are exempt from sales tax when shipping to a Wyoming address.

The State of Wyoming requires the collection of taxes on certain products sold by NPMEX and delivered to a Wyoming address. These taxes must be collected on (1) any coins that have gold or silver content but are not recognized as mediums of exchange for the payment of debts and taxes; (2) any coins or bullion made of platinum, palladium, or copper; (3) any bullion products that are made of gold or silver if such bullion is not stamped or imprinted with its weight and purity; (4) accessory items; and (5) processed items. All other products sold by NPMEX are exempt from these taxes.

The following definitions apply to products on which taxes must be collected in Wyoming:

  • Medium of Exchange: Coins or currency that are acceptable as a measure of value and a standard of exchange for goods and services.
  • Coin: A small, flat, round piece of metal which is, or has been used as legal tender, with a number showing its value and often a decorative picture.
  • Bullion: Precious metal that is valued solely upon its precious metal content, whether in coin or bar form.
  • Accessory Items: Items such as holders, tubes or coin flips.
  • Processed Items: Precious Metals that have been processed by third parties into items valued on more

than their Precious Metal content, such as jewelry, statues or colorized coins.Sales taxes in Wyoming are calculated at checkout on the NPMEX website based on (1) the taxability of products sold by NPMEX in Wyoming set forth above, and (2) the specific tax rates established by the taxing jurisdiction of the delivery address in Wyoming.
